Judge Reggie B. Walton ruled late Sunday, rejecting a lawsuit filed by the town in June that argued the project violates the Rivers and Harbors Act and would compromise flood barriers built after Tropical Depression Lowell caused 10 feet of water in homes in 2008. The Presidio Municipal Development District expressed disappointment, saying the construction could cause "real harm to real people."
