A Bench of Justice Manoj Jain Dismissed the Plea, Saying, "I'm Dismissing It

Balyan had challenged the trial court's May 27 order rejecting his second bail application. In its 22-page order, the trial court had said there were no reasonable grounds to rule out his involvement and highlighted the peril of a criminal nexus between a politician and a gangster. Balyan, represented by senior advocate Sunil Dalal, argued he had been in custody since December and that his continued detention was unnecessary as the investigation was complete.

The Delhi Police filed a chargesheet on May 1, alleging Balyan used his political influence to fund Sangwan's syndicate and protect its members. Police also claimed he used VP Ns and encrypted messaging to communicate with Sangwan, and used phones registered in family members' names. Balyan called his arrest "frivolous, based on past FI Rs and co-accused statements, and alleged misuse of MCOCA.

He was arrested on December 4 in a case of organised crime and extortion, shortly after being granted bail in an extortion case stemming from a May 31, 2022 threat demanding ₹1 crore. On Friday, a Delhi court discharged him in that extortion case, noting the probe assumed suspects were culprits without direct evidence.
