Under the Settlement, Openai Must Post Jobs Publicly, Accept Electronic Applications, and Train Staff on Anti-discrimination Policies

The US Department of Justice has reached a $3.2 million settlement with OpenAI and a subsidiary over allegations the company discriminated against American workers by favoring those with temporary visas. The DOJ found OpenAI failed to advertise certain roles on its external jobs site, required paper applications for some positions, and ran late-night radio ads. Under the settlement, OpenAI must post jobs publicly, accept electronic applications, and train staff on anti-discrimination policies.

The company will pay $1.2 million in civil penalties and $2 million into a back-pay fund for victims, though the DOJ hasn't detailed how payments will be determined. Similar settlements were reached with Meta in 2021 and Apple in 2023. The move comes amid tighter immigration policies under President Trump, including a September 2025 executive order adding a $100,000 fee to some H1-B visa applications.
