Justice Department Claims That They Favored Foreign Workers on Temporary Visas and Discriminated Against American Job Applicants in Hiring

The Justice Department said Tuesday that the companies recruited foreign workers for some roles and discouraged U.S. applicants by requiring paper applications, advertising jobs on late-night radio, and skipping external job postings. OpenAI denied wrongdoing in the settlement, which includes $1.2 million in penalties and $2 million for alleged victims. The company also agreed to revise policies, conduct training, and face monitoring.

Assistant Attorney General Harmeet Dhillon said the settlement ensures OpenAI changes practices so U.S. workers get fair opportunities. The case follows at least a dozen similar settlements since last year, mostly involving tech firms. President Donald Trump has sought to limit foreign hiring, including a $100,000 fee on new H-1B visas, currently blocked by legal challenges.
